Content, progress and pedagogy of the module

  • Voldgift er en alment anvendt metode til konfliktløsning og advokater såvel som in-house jurister med interesse for formueretten bør være bekendt med den. I faget vil studerende lære om de internationale regler og principper for voldgift, diverse voldgiftsinstitutioner, FN’s modellov om voldgift som også anvendes i Danmark, indgåelse af voldgiftsaftaler, fortolkning af voldgiftsklausuler m.m.

 

  • Arbitration is a common way for businesses to settle disputes and legal advisors should be familiar with the intricacies of the field. In this course students will obtain knowledge of the commonly used arbitration institutions, the legal framework of international arbitration, the formation and interpretation of an arbitration agreement, and the challenge of an arbitration award.

Learning objectives

Knowledge

  • The international and domestic framework of arbitration
  • The methods and purpose of arbitration as a dispute resolution mechanism
  • The principles of international arbitration.
  • The polycentric setting in which international arbitration is set
  • The dominant arbitration laws and conventions, including also the New York Convention on Enforcement and the UNCITRAL Model Arbitration Law

Skills

  • Master the terminology and concepts of the field.
  • Apply the relevant rules and ways of interpretation
  • Identify and analyse international arbitration law problems and risks
  • Interpret and apply the rules of the relevant arbitration rules, e.g. the N.Y. Convention and the UNCITRAL Model Law
  • Independently locate relevant legal sources in the field, including case law, traveux preparatoire and scholarly works
  • Explain and react to the particularities of international arbitration
  • Present and explain an analysis of a theoretical or practical problem in a convincing and appropriate manner

Competences

  • Apply the appropriate interpretation method salient to arbitration law
  • Recognize international arbitration law problems.
  • Recognize risks in cross-border dispute resolution and react appropriately
  • Advise on legal matters relating to international arbitration
  • Advise on the risks involved in international arbitration
  • Advise on the pros and cons of arbitration as a dispute resolution mechanism
